Terms of Service
Last updated:
These terms are the agreement between you and us when you use da.place: the app for iPhone and the website da.place. By creating an account you accept them, so please read them first. If you created your account before October 17, 2026, they apply to you from November 16, 2026, or from when you accept them in the app, whichever comes first.
1. About these terms
da.place is run by its developer, an individual based in the European Union: the seller named on da.place's page in the App Store (“we”, “us”; see Legal). Our Community Guidelines are part of these terms. Our Privacy Policy explains what we do with your personal data. If you use the website without an account, sections 6, 7 and 10 to 16 apply to you too.
2. Who can use da.place
- You must be 16 or older.
- You must not be barred from using da.place by the law that applies to you.
- One account is for one person: don't share it, sell it or make one for someone else.
3. Your account
- You sign in with Apple or Google. Keep your devices and your Apple or Google account secure: what happens in your da.place account is your responsibility.
- Your username must not pretend to be someone else, mislead about who you are, be offensive, or use a name or brand you have no right to. We may change or take back a username that does.
- When you change your username or delete your account, we hold the old username for 14 days before anyone else can take it.
4. What da.place offers
da.place lets you save places on a map in lists, keep them private, share them with people you choose, make them public in the app, and, with the Creator plan, publish them on the web and invite people with links. da.place is free to use; the app shows the limits of your plan, such as how many lists and places you can have. We keep improving da.place, so features may change, and test versions of the app may not always work as they should.
5. Your content
- It stays yours. You keep every right you have in the lists, places, notes and photos you add.
- What you let us do. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt (for example, resize a photo), show and transmit your content, only to run da.place and show your content the way you choose. Our service providers may do this for us. We don't sell your content, use it for advertising, or use it to train AI models.
- What you let other people do. Whoever can see your content in da.place may view it and use it with da.place's features. If someone adds your public list, it stays in their library, and keeps updating, even if you later make it private; it leaves their library when they remove it or you block them. If you delete a list, everyone who added it or joined it with an invite link keeps a copy of it, with your notes, photos and username. The copy becomes theirs, to change, share or make public in da.place. If you delete your account, the copies made then keep the lists' titles, descriptions and places, without your notes, photos or name; copies of lists you deleted earlier keep your notes and username, and your photos leave them.
- How long. These licences end when you delete the content or your account, except for the copies other people keep as just described, our backups for up to 7 days, the title of a list in reports about it, and what we must keep to handle a report, a legal claim or a legal obligation.
- What you promise. You have the right to post what you post: post only photos you took or may share. Your content doesn't break the law or these terms, and doesn't intrude on anyone's privacy, for example by showing a private home or a recognisable person in a private moment without their consent.
- We don't check content before it appears, but we act on what breaks the law or these terms (section 7).
6. The rules
There is no tolerance on da.place for objectionable content or abusive behaviour: we remove it, and we may close the accounts behind it. The Community Guidelines say what is not allowed. In short, don't post anything illegal, sexual, violent, hateful or harassing, or anything that exposes where a private person lives. And don't misuse da.place:
- don't access it by automated means, collect data from it in bulk or get round its limits;
- don't interfere with its security or with how it works, or try to reach what you are not allowed to see;
- don't copy, take apart or reverse-engineer the app, except where the law allows it;
- don't send spam, scams or malicious links, and don't pretend to be someone else.
7. Reports and moderation
- Reporting. In the app, tap Report list in a list's menu, or Report in a person's profile menu. On the website, use the Report link at the bottom of a list or invite page; you don't need an account. You can also write to support@da.place with a link to what you report and why you think it is illegal or breaks our rules. We confirm notices we receive by email, and tell you what we decided.
- How we decide. A person reviews every report against the law and our rules. We may also act on our own when we find a problem. We don't use automated tools to decide about content; automatic limits on how often something can be done only protect the service.
- What we may do, depending on how serious it is and whether it happened before: remove content or make it unavailable, for example take a list down, which hides it from everyone but its owner and switches off its web page and links; or suspend or close an account.
- We tell you why. When we act on your content or account, we tell you by email what we did, why, and how to appeal, unless the law does not allow it or it would put someone at risk.
- Appeals. If you disagree with a decision, write to support@da.place within six months of our message. A person, not an automated system, looks at the case again, and we reverse the decision if it was wrong. You can always go to court instead.
- Authorities. We follow lawful decisions of authorities, and we tell them when content suggests a threat to someone's life or safety.
8. Blocking
You can block a person from their profile or from the menu of their list, and unblock them in Settings → Blocked people. The Community Guidelines explain what blocking does.
9. The Creator plan
Publishing lists on the web and invite links belong to the Creator plan, which you cannot subscribe to yet. When you can:
- you subscribe in the app, and Apple bills you through your Apple Account under Apple's terms;
- the app shows what the plan costs and includes before you subscribe;
- a subscription renews automatically unless you turn it off at least 24 hours before the end of the period; you manage and cancel it in your Apple Account settings, and refunds are handled by Apple;
- if we change what the plan includes or what it costs, we tell you in advance, and you can cancel before the change applies to you.
10. Places and your safety
Places on da.place come from the people who add them and from Apple Maps. They can be wrong or out of date, and we don't check or recommend them. Use your own judgement when you visit a place, respect private property and local rules, and keep yourself safe.
11. Other services
Maps and place search come from Apple, and you can sign in with Apple or Google and get directions in Apple Maps or Google Maps. Their own terms apply when you use them, and we are not responsible for them.
12. Our rights
The da.place app, website, design, name and logo belong to us. You may use them only as da.place allows, for example by sharing links to lists. If you send us an idea or feedback, we may use it without owing you anything.
13. Ending your use
- You can stop using da.place and delete your account at any time: in the app, in Settings → Delete account, or by writing to privacy@da.place.
- We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other people. Where we can, we warn you first, and we tell you why and how to appeal, as section 7 describes.
- If we ever stop offering da.place, we will tell you at least 30 days before, so you can ask us for a copy of your data.
14. Our responsibility
- da.place is free, and we offer it as it is. We work to keep it running and your data safe, but we can't promise that it will always be available or free of errors.
- Nothing in these terms limits our liability where the law does not allow it to be limited, including for intent or gross negligence, for death or personal injury, and under the consumer protection law that applies to you.
- Otherwise, as far as the law allows, we are not liable for indirect or unforeseeable loss.
15. Changes to these terms
We may change these terms, for example when we add features or the law changes. If a change affects you, we tell you at least 30 days before it applies, in the app or by email, and you can delete your account before then if you don't agree. A change the law or your safety requires may apply sooner. The date at the top shows the current version.
16. Law and disputes
These terms are governed by the law of the EU member state where we are established. If you use da.place as a consumer, you also keep the protection of the mandatory law of the country where you live, and you can bring a claim in the courts there. If something goes wrong, please write to support@da.place first: most problems can be solved that way.
17. If you got the app from the App Store
- These terms are between you and us, not Apple. Apple is not responsible for the app or its content. We, not Apple, provide its maintenance and support: write to support@da.place.
- You may use the app on Apple devices you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow. The licence is personal and you can't transfer it.
- If the app fails to meet a warranty that applies by law, you may tell Apple, and Apple will refund what you paid for the app, if anything. Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claim about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection and privacy claims, and claims that the app infringes someone's intellectual property.
- You confirm that you are not in a country under a United States government embargo or designated by it as supporting terrorism, and that you are not on a United States government list of prohibited or restricted parties.
- You must also follow the terms of other services you use with the app, such as your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
